Introduction These Terms and Conditions (“Terms”) govern your use of Silhouette MD’s website and related services (collectively, the “Service”). Silhouette MD is a DBA of Elevate Wellness Group LLC (“Silhouette MD”, “we”, or “us”).
Acceptance Your use of the Service constitutes acceptance of these Terms. We reserve the right to modify these Terms at any time. Continued use of the Service after any changes indicates your acceptance of the updated Terms.
Our Services Silhouette MD provides physician-supervised medical weight loss services, prescription management, hormone therapy, mild steroid therapy for men, aesthetic and wellness treatments, and associated health products. Services are provided through licensed healthcare providers (“Providers”) affiliated with Silhouette MD.
Medical Services Disclaimer Silhouette MD serves solely as a platform and facilitator connecting you with licensed healthcare providers (the “Providers”). Silhouette MD (Elevate Wellness Group LLC) itself is not a medical provider, does not practice medicine, and does not directly provide medical services or medical advice. Any medical care, treatment, prescriptions, or recommendations you receive through the Service are provided exclusively by licensed healthcare Providers, who maintain sole responsibility and liability for such services.
All prescribing decisions are made independently and solely by licensed physicians and nurse practitioners affiliated with Silhouette MD’s provider network.
By accepting these Terms, you acknowledge and expressly agree that Silhouette MD shall have no liability or responsibility whatsoever for medical services provided by Providers, including without limitation diagnosis, treatment decisions, prescriptions, or medical advice, and you expressly waive and release any and all claims against Silhouette MD relating to such services.
Provider Relationship Silhouette MD facilitates virtual and in-person consultations with Providers. Silhouette MD does not practice medicine directly. Any medical services you receive through Silhouette MD are provided by independent Providers. By using the Service, you are entering into a provider-patient relationship with these Providers, not directly with Silhouette MD.
Eligibility Our Service is intended solely for individuals aged eighteen (18) or older. By using the Service, you represent that you are at least eighteen (18) years old.
Financial Responsibility Silhouette MD does not participate in federal or state healthcare programs such as Medicare or Medicaid. All services and products are provided on a cash-pay basis. You are fully responsible for the costs of services and products, and neither you nor Silhouette MD will submit claims for reimbursement to any federal or state healthcare program.
Subscription Services Certain products and services are provided on a subscription basis. Your subscription will automatically renew unless canceled. You may cancel or modify your subscription through your online account or by contacting our Customer Care Team.
Prescription Medications Certain services require prescriptions from licensed Providers. Prescriptions will be filled either through our affiliated pharmacy partners or through a pharmacy of your choice, depending on the product.
No prescription medication—compounded or otherwise—will be dispensed without a valid prescription following a licensed provider’s clinical evaluation. Silhouette MD does not sell or ship medications
Telehealth Consent You agree to the use of telehealth for consultations and services provided by Silhouette MD Providers. You acknowledge that telehealth has certain limitations compared to in-person consultations.
Privacy and Security Your privacy is important. Certain health-related information provided through our Service is protected by federal and state privacy laws (e.g., HIPAA). Such information will be handled securely and in compliance with applicable laws, as detailed in our Privacy Policy. Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal information.
Registration and Security You are responsible for maintaining the confidentiality of your account information and password and for restricting access to your account. Notify us immediately of any unauthorized use of your account.
Prohibited Uses You agree not to misuse the Service, including but not limited to illegal activities, harassment, interference with others’ use, or attempts to breach the Service’s security.
Intellectual Property Silhouette MD owns all rights to the Service’s content, branding, and intellectual property. You are granted a limited, non-transferable license to use the Service strictly for personal use.
Limitation of Liability To the extent permitted by law, Silhouette MD shall not be liable for indirect, incidental, or consequential damages arising from the use of the Service. Our liability, if any, shall not exceed $1,000.
Indemnification You agree to indemnify and hold Silhouette MD and its affiliates harmless from any claims arising from your misuse of the Service or violation of these Terms.
Termination Silhouette MD reserves the right to terminate your access to the Service at any time, without notice, for violations of these Terms or for any reason deemed necessary by Silhouette MD.
Arbitration Agreement Disputes shall be resolved by confidential arbitration administered by the American Arbitration Association (“AAA”) in Salt Lake City, Utah, under its Consumer Arbitration Rules. You may opt-out within 30 days of acceptance by contacting our Arbitration Opt-Out department.
Governing Law These Terms shall be governed by the laws of the State of Utah.
Entire Agreement These Terms constitute the entire agreement between you and Silhouette MD regarding your use of the Service.
